LEGAL NOTICE FOR DISHONOUR OF CHEQUE UNDER SECTION 138 OF THE NEGOTIABLE INSTRUMENTS ACT, 1881

Sir/Madam,

Under instructions and on behalf of my client {{f4_name_of_payee_complainant}}, residing / having its office at {{f5_address_of_payee}} (“My Client”), I hereby serve upon you the present legal notice as under:

1. FACTS OF THE CASE

That you are well known to my Client and had financial / business dealings with my Client.

That in discharge of your legally enforceable debt/liability, you issued in favour of my Client the following cheque:

That the dishonour of the cheque has caused grave financial loss, inconvenience, and mental harassment to my Client.

2. LEGAL POSITION

That the dishonour of the cheque issued by you attracts the penal provisions of Section 138 of the Negotiable Instruments Act, 1881, which is a criminal offence punishable with imprisonment and/or fine.

That this notice is being issued to you within the statutory period as prescribed under law.

3. DEMAND

Through this notice, you are hereby called upon to pay to my Client the cheque amount of INR {{f8_cheque_amount}}, along with incidental charges, within 15 (fifteen) days from the date of receipt of this notice.

4. CONSEQUENCES OF NON-COMPLIANCE

Take notice that if you fail to make the aforesaid payment within the stipulated period of 15 days, my Client shall be constrained to initiate appropriate criminal proceedings under Section 138 read with Section 142 of the Negotiable Instruments Act, 1881, as well as other civil and criminal proceedings as may be advised, entirely at your risk as to cost and consequences, without any further reference to you.

This notice is issued without prejudice to all other rights, remedies, and claims available to my Client in law and equity.

5. MODE OF PAYMENT
